§ 50-176. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Hazardous material. Any substance or material which, in the determination of the city fire chief or his authorized representative, is dangerous or harmful to the environment or human or animal life, health or safety; or constitutes a danger or threat to the public health, safety or welfare, including, but not limited to, explosives, pyrotechnics, flammable gas, flammable compressed gas, nonflammable compressed gas, flammable liquid, oxidizing material, poisonous gas, poisonous liquid, irritating material, etiologic material, radioactive material, corrosive material, liquified petroleum gas, or any other hazardous substance or material as defined under the Fire Prevention Code, MCL 29.1 et seq., or the Hazardous Waste Management Act, MCL 299.501 et seq.

    Hazardous material incident. A fire, explosion, spill, leak or other accidental, negligent, improper or dangerous discharge or release of a hazardous material.

    Responsible party. Any person who owns, possesses or controls a hazardous material involved in a hazardous material incident, and any person whose transportation, storage, handling, sale, use or processing of a hazardous material causes or results in a hazardous material incident.
