§ 110-162. Parking and storage.

  • The regulations relating to the storage and parking of house trailers, boats and trailers shall be the only applicable regulations of this Code relating to such parking and storage. Provisions of other sections of this Code, which, if applied, would be inconsistent with or in conflict with the regulations set forth in this section shall not be applicable to such parking and storage.

    (1)

    No person shall park overnight or permit the parking overnight of any house trailer, boat or trailer on any street, park, or other public place within the city; however, the city commission may, upon application, permit such parking for a period of not more than ten days if the vehicle is to be used for a public purpose.

    (2)

    No person shall occupy or shall permit another person to occupy any house trailer on any private property within the city for a period in excess of 48 hours, except in an authorized trailer camp licenced under the provisions of Act No. 243 of the Public Acts of Michigan of 1959 (MCL 125.1001 et seq., MSA 5.278(31) et seq.), as amended. House trailers parked pursuant to commission approval as provided for in subsection (1) of this section may be occupied during the period of such authorized parking when occupancy is necessary for security purposes.

    (3)

    No house trailer, boat or trailer shall be parked or stored outside a building in any residential zone district as described in chapter 126 of this Code, except in accordance with the following regulations:

    a.

    No house trailer, boat or trailer shall be parked or stored outside a building in the front yard in any residential zone district as described in chapter 126 of this Code, except as otherwise provided in this division.

    b.

    No house trailer, boat or trailer shall be parked or stored at the side of any dwelling between the front open space and the rear open space for a period in excess of 30 consecutive days nor for more than 30 days within any six-month period.

    c.

    Parking or storage of house trailers or boats in the rear open space shall be done in such a manner that no portion of the house trailer or boat shall be closer than ten feet to the nearest house.

    d.

    House trailers or boats shall not have fixed connections to electricity, water, gas or sanitary sewer facilities; and at no time shall this equipment be used for living or housekeeping purposes except as herein provided.

    e.

    House trailers, boats and trailers may be parked anywhere on the premises for loading or unloading purposes for a period of not more than 48 hours.

    f.

    House trailers, boats and trailers must be parked or stored in such a manner that they do not create a dangerous or unsafe condition on the property where parked or stored.

    g.

    No house trailer or trailer shall be parked or stored unless it has been licensed by the state for operation during the current year or the year preceding the parking or storage.

    h.

    No boat shall be stored for more than 12 months within a 13-month period.

    i.

    House trailers, boats and trailers in excess of eight feet in width and 28 feet in length may not be temporarily stored as herein provided at any time.

    j.

    No more than one house trailer and one boat may be stored on any lot in a residential zone district at any given time.

    k.

    No house trailer, boat or trailer shall be parked or stored on a vacant lot in a residential zone district, except where such lot is contiguous and adjacent to the residential lot occupied by the owner. No house trailer, boat or trailer parked or stored on such vacant lot shall be located in the portion of the lot extending from the front lot line for a distance equal to the depth of the front yard of the owner's adjacent residence.

    l.

    The provisions of this section shall not be applicable to the parking or storage of any house trailer, boat or trailer on any residential lot if:

    1.

    The person storing the house trailer, boat or trailer was the owner thereof at the time of the adoption of the ordinance from which this section is derived;

    2.

    The house trailer, boat or trailer was stored on the owner's residential lot prior to the adoption of this division; and

    3.

    Because of the size of the lot, location of the buildings or other physical factors, it is not physically possible to comply with the provisions of this section.

    (4)

    No person shall park or store any trailer outside a building in any business zone district, as described in chapter 126 of this Code, except as part of a lawful trailer sale or rental business, for periods greater than 72 hours without first obtaining a permit for such storage or parking from the building official in accordance with the following regulations:

    a.

    The building official shall, upon application, permit trailers to be parked on building construction sites for use during the period of construction on such site.

    b.

    The building official shall, except as provided in subsection (4)a. of this section, upon application, permit trailers to be parked or stored outside buildings for any lawful purpose for periods not to exceed two weeks in any six-month period.
